At Exclusive Cruises, we are committed to providing exceptional private boat experiences while ensuring the safety and comfort of every guest. By confirming a booking, you agree to the following Terms & Conditions.
1. Reservations & Deposits
- A deposit is required to confirm all reservations.
- A booking is not considered confirmed until the required deposit has been received.
- The deposit secures your selected vessel and date exclusively for your party.
2. Final Payment
- The remaining balance must be paid no later than 48 hours prior to your excursion unless otherwise agreed in writing.
- Reservations that remain unpaid after this deadline may be cancelled without notice.
- Cancellations made within 48 hours of the scheduled departure are subject to the full charter fee.
3. Charter Cancellations

Deposit Refund Policy
- For vessels under 46 feet, deposits are fully refundable if the reservation is cancelled at least 48 hours prior to the scheduled charter, unless otherwise specified by Exclusive Cruises or in the signed charter agreement. If the reservation is cancelled within 48 hours of departure, the full charter fee will be charged
- For vessels 46 feet and over, deposits are refundable only if the reservation is cancelled more than 7 days before the scheduled charter, unless otherwise specified by Exclusive Cruises or in the signed charter agreement. Cancellations made within 7 days of the charter are non-refundable.
- Any outstanding balance due at the time of cancellation remains payable.
Cancellation by Exclusive Cruises
Safety is always our highest priority.
If weather or sea conditions prevent the excursion from departing and the vessel has not yet left the port, we will first attempt to reschedule your excursion.
If rescheduling is not possible, your deposit and any payments received will be refunded in full.
Exclusive Cruises is not responsible for additional expenses resulting from weather-related cancellations, including accommodation, transportation, or other travel arrangements.
4. Weather Policy
The captain has the sole authority to determine whether weather and sea conditions are safe for navigation.
Rain alone is not considered grounds for cancellation. Excursions may proceed during light rain or changing weather provided conditions remain safe.
If weather conditions deteriorate during the excursion, the captain may modify the itinerary, shorten the trip, or return to port if necessary for the safety of passengers and crew.
5. Vessel Substitution
In the unlikely event that your reserved vessel becomes unavailable due to unforeseen circumstances, Exclusive Cruises reserves the right to provide a comparable or upgraded vessel of equal or greater value.
6. Charter Duration & Overtime
A full-day charter operates for approximately 6 to 6.5 hours.
Excursions extending beyond are subject to overtime charges:
- Boats under 28 ft: €50 per hour
- Speedboats: €150 per hour
- Yachts 50 ft and above: €200 per hour
7. Guest Delays
A complimentary one-hour waiting period is included for direct sea transfers.
After one hour, waiting time will be charged (rounded up to the next full hour):
- Boats under 28 ft: €50 per hour
- Speedboats: €150 per hour
- Yachts 50 ft and above: €200 per hour
Additional charges must be settled before disembarkation by cash or credit card.
8. Guest Responsibilities
The charterer is responsible for the conduct of all members of their party, including children.
Guests are expected to follow all safety instructions provided by the captain.
Exclusive Cruises reserves the right to terminate any excursion without refund if guests engage in unsafe, illegal, abusive, or inappropriate behaviour after receiving a warning from the captain.
9. Medical Fitness
Guests are responsible for ensuring they are medically fit to participate in a boating excursion.
Some vessels and excursions may not be suitable for guests with limited mobility, certain medical conditions, or those undergoing medical treatment. Please advise us in advance so we can recommend the most appropriate vessel whenever possible.
10. Captain's Authority
The captain has complete authority regarding the safe operation of the vessel.
This includes decisions concerning:
- navigation
- weather-related route changes
- swimming stops
- itinerary modifications
- returning to port if necessary
The captain will not follow instructions that compromise safety or violate maritime regulations.
11. Liability
While every reasonable effort is made to provide a safe and enjoyable experience, Exclusive Cruises cannot accept responsibility for:
- loss, theft, or damage to personal belongings;
- delays or itinerary changes caused by weather, sea conditions, port authorities, or force majeure;
- circumstances beyond our reasonable control.
All vessels carry the legally required passenger insurance. Personal injury is covered under the applicable insurance policy.
12. Mechanical Issues
Should a mechanical failure occur before or during your charter, we will make every reasonable effort to provide a replacement vessel.
If a suitable replacement is unavailable, guests will receive a refund proportional to the unused portion of the excursion.
13. Complaints
Should any issue arise during your excursion, please notify your captain immediately so every reasonable effort can be made to resolve it while on board.
Any complaint submitted after the excursion that was not raised during the charter may limit our ability to investigate or resolve the matter.
14. Governing Law
These Terms & Conditions are governed by the laws of Italy.
Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of Salerno, Italy.
